Home for the Holidays...and Beyond!
Last month, I was interviewed by journalist Michael Estrin for an article on foreclosure that appeared on bankrate.com.
"...uncovering errors can produce real results for troubled homeowners. According to McCaffery, homeowners may be able to make a good case for halting a foreclosure if the bank can't show it has the right to foreclose."
Today I was able to tell a family that their foreclosure has been stopped. The bank's case against them was dismissed with prejudice. They stopped by and thanked us with this cake!
It's the third time I've been able to deliver that news to a client, and it's a great feeling to tell a family they are not losing their home. It's also a demonstration that our strategy is working.
Our firm has handled hundreds of foreclosure defense matters and not one of our clients at the end of their case faced any personal deficiency.
While it truly is rare to be able to keep a home and owe no money to any entity to do so - besides the property taxes that must be paid to the government - the results of unethical and illegal lender practices, such as predatory lending and improper paperwork, increasingly offer opportunities to legally and legitimately stop and end foreclosure proceedings.
While I won't detail our firm's strategy, I will say this is definitely a war to be won in the trenches.
While banks are turning to the White House and Congress for relief, families at risk of foreclosure need to fight their battles in the courts where we can make their case, and even win it.
